Terms of Service

1. Agreement

By accessing or using Stirpe at stirpe.ai (the "Service"), you agree to be bound by these Terms of Service ("Terms"). The Service is operated by Geyserich, a company based in Luxembourg ("we", "us", "our"). If you do not agree to these Terms, do not use the Service.

2. Description of Service

Stirpe is an AI-powered genealogical intelligence platform. It allows you to upload images or files of historical documents for automated transcription, translation, and genealogical analysis powered by large language models. Analysis results, extracted persons, family relationships, and historical locations are stored in a personal knowledge graph accessible from your account.

The Service is provided for personal genealogical research purposes. Results are generated by AI and should be treated as research aids rather than definitive historical records.

3. Eligibility

You must be at least 18 years old to use the Service. By using Stirpe, you represent that you meet this requirement and that the information you provide is accurate.

4. Your Account

You are responsible for maintaining the security of your account credentials and for all activity that occurs under your account. Notify us immediately at contact@geyserich.com if you suspect unauthorised access.

We reserve the right to suspend or terminate accounts that violate these Terms or are used for unlawful purposes.

6. Your Content and Data

You retain full ownership of the documents you upload and the analysis results generated from them. By uploading documents, you grant Geyserich a limited, non-exclusive licence to process and store that content solely for the purpose of providing the Service to you.

You are solely responsible for ensuring that any documents you upload do not infringe third-party rights and that you have the legal basis to process any personal data of living individuals contained within them.

We do not use your documents or analysis results to train AI models. Your data is never sold to third parties.

7. AI-Generated Content

Analysis results, transcriptions, translations, and genealogical findings are generated by AI and may contain errors, omissions, or inaccuracies. They are provided for research assistance only and do not constitute legal, historical, or professional genealogical advice. You should verify AI-generated results against primary sources before relying on them.

8. Intellectual Property

The Stirpe platform, its branding (including the name "Stirpe", "Geyserich", and associated marks), design, code, and structure are the exclusive property of Geyserich and are protected by applicable intellectual property laws. You may not reproduce, distribute, or create derivative works from any part of the Service without our prior written consent.

9. Availability and Changes

We provide the Service on a best-efforts basis. We do not guarantee that the Service will be available at all times or free of errors. We may modify, suspend, or discontinue any part of the Service at any time with reasonable notice where practicable.

We reserve the right to update these Terms. Material changes will be communicated by updating the effective date above. Continued use of the Service after changes constitutes acceptance.

10. Disclaimer of Warranties

To the fullest extent permitted by applicable law, the Service is provided "as is" and "as available" without any warranty of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, or non-infringement. We do not warrant that AI-generated outputs are accurate or complete.

11. Limitation of Liability

To the maximum extent permitted by Luxembourg law, Geyserich and its affiliates shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of data, loss of profits, or loss of genealogical research, arising from your use of or inability to use the Service, even if we have been advised of the possibility of such damages.

Our total aggregate liability to you for any claim arising from these Terms or the Service shall not exceed the greater of (a) the amount you paid us in the twelve months preceding the claim, or (b) €50.

Nothing in these Terms limits liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability that cannot be excluded under applicable law.

12. Governing Law and Disputes

These Terms are governed by and construed in accordance with the laws of the Grand Duchy of Luxembourg, without regard to its conflict of law rules.

Any dispute arising from or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Luxembourg City, Luxembourg, without prejudice to your rights as a consumer under the laws of your country of residence if you are an EU consumer.
